China Labour Law Updates: March 2025

Updates to Work-Related Injury Insurance Benefits

Chongqing City

Chongqing City has recently issued a notice regarding the adjustment of regular benefits for employees who have suffered work-related injuries and for those with dependent relatives, effective 1 January 2025. This adjustment applies to employees who were already receiving work-related injury benefits in accordance with regulations prior to 31 December 2024, and who continue to meet the eligibility criteria after 1 January 2025. The adjustment details are as follows:

  • Disability Allowance Adjustment Standards
    • Grade 1 Disability increased by RMB300 per month
    • Grade 2 Disability increased by RMB280 per month
    • Grade 3 Disability increased by RMB260 per month
    • Grade 4 Disability increased by RMB240 per month
    • For employees with Grade 5 or 6 work-related injuries who are not assigned work, their disability allowance will be increased by no less than RMB 180 per month.
  • Survivor Benefits for Dependents
    • Spouses, widowed elderly individuals, and orphans will receive RMB120 per month.
    • Each other relative will receive an additional RMB100 per month.

Updates on Population and Family Planning Policies

Chengdu City, Sichuan Province

Chengdu City, Sichuan Province, has introduced an additional month of maternity leave for female employees who are exclusively breastfeeding, in line with relevant regulations. A special notice has been issued regarding the implementation of this policy. Effective 24 February 2025, the key details include:

  1. Female employees who are exclusively breastfeeding should visit Baby-Friendly Hospitals to apply for a Certificate of Exclusive Breastfeeding between 3 to 5 months after childbirth.
  2. Employers may grant one month of exclusive breastfeeding maternity leave to eligible employees upon presentation of the certificate issued by the Baby-Friendly Hospital. During this period, employees are entitled to standard salary and benefits.
  3. While branches outside the Chengdu jurisdiction should follow their respective local regulations, they are encouraged to align with Chengdu’s standards where possible.
