Annual Leave & Other Leave Policies in Vietnam

Understanding Vietnam's annual leave policies is crucial for both employees and employers. This guide provides comprehensive insights into annual leave regulations, entitlements, and related benefits.

Annual Leave Entitlement

Employees in Vietnam are entitled to paid annual leave based on their length of service:

  • Minimum Entitlement: 12 working days per year.
  • Additional Leave: Employees in hazardous conditions receive extra leave days.

 

Sick Leave

The types of sick leave in Vietnam include:

  • Short-term sick leave
    • Normal working conditions:
      • 30 working days / year (under 15 years SI contribution)
      • 40 working days (15-30 years SI contribution)
    • Heavy, hazardous or dangerous occupations working conditions:
      • 40 working days / year (under 15 years SI contribution)
      • 50 working days / year (under 15-30 years SI contribution)
  • Long-term sick leave
    • 180 days / year including public holidays, New Year holidays and weekends.
  • Children sick leave
    • Under 3 years old – Cannot exceed 20 working days / year.
    • 3 to under 7 years old – Cannot exceed 15 working days / year.

 

Maternity Leave and Adoption

Female employees receive 6 months’ maternity leave, with an additional 30 days for each additional child. Upon childbirth or adoption, they receive a lump-sum allowance equivalent to two months’ minimum salary per child.

  • Prenatal check-up’s:
    • Working mothers are entitled to 5 prenatal check-ups, one day for each check-up.
  • If working mother faces miscarriage, abortion, stillbirth or pathological abortion, she is entitled to:
    • If the pregnancy is under 5 weeks: 10 days of leave
    • If the pregnancy is between 5 weeks and under 13 weeks: 20 days of leave
    • If the pregnancy is between 13 weeks and under 25 weeks: 40 days of leave
    • If the pregnancy is 25 weeks or more: 50 days of leave

 

Paternity Leave

Fathers are entitled to:

  • 5 working days of paid leave when their spouse or partner gives birth.
  • 7 working days of paid leave if the birth involves surgery, if the child is born prematurely (before 32 weeks), or if there are complications during the birth.

In addition to annual leave, employees are entitled to paid leave on public holidays. This includes:
