Probation Period in the UAE

The probation period in the UAE is a critical phase for both new employees and employers, allowing both parties to assess suitability for the role.

Probation Period in the UAE

  • Maximum Duration
    • The probation period cannot exceed six (6) months.
    • An employee cannot be placed on probation more than once by the same employer.
  • Written Notification Requirement
    • The probation period must be clearly stated in the employment contract.
    • Any changes to the employment status (resignation or termination) during this time must be communicated in writing.
  • Termination During Probation
    • By Employer:
      • Employer can terminate employment during probation by giving 14 days’ written notice.
    • By Employee (Leaving UAE):
      • Employee must give 14 days’ written notice if they plan to resign and leave the UAE.
    • By Employee (Joining another UAE employer):
      • Employee must give 30 days’ written notice.
      • The new employer may be required to compensate the previous employer for recruitment costs.

 

  • Employee Rights During Probation
    • Employees on probation are entitled to full wages as per their contract.
    • They are also entitled to leave benefits, but no annual leave accrual is required unless otherwise agreed.
      • The worker shall not be entitled to a paid sick leave during the probationary period.
      • The employer may agree to grant the worker a leave from his annual leave balance during the probationary period, while the worker shall reserve his right to be compensated for the remainder of his annual leave balance in case he does not pass the probationary period.
    • Health insurance coverage is mandatory, even during probation.

 

  • Consequences of Early Resignation
    • If the employee resigns to join another UAE company without giving the proper notice, a labour ban (1 year) may be imposed.
    • In practice, this may affect visa renewals or future employment transfers, especially for lower-skilled jobs.
