Retirement Age in Macau

Unlike some jurisdictions, Macau does not set a compulsory retirement age under the Labour Relations Law (Law no. 7/2008). This provides flexibility for both employers and employees in deciding when employment should end. However, retirement planning is closely tied to Macau’s Social Security Fund, which provides pensions and benefits for eligible workers.

Retirement Age in Macau

  • No mandatory retirement age – Employment contracts do not automatically end at a certain age.
  • Employers cannot unilaterally force retirement based on age alone; termination must follow the Labour Law’s rules on notice and severance.
  • Many employers, however, set internal retirement guidelines (often around 65) for workforce planning.

Social Security and Old-Age Pension

Employees who contribute to the Macau Social Security Fund (FSS) are eligible for retirement benefits.

  • Eligibility: Residents who reach the age of 65 and have made the minimum required contributions can claim an old-age pension.
  • Early pension: Possible at 60 years old, if contribution conditions are met.
  • Pension amount: A fixed monthly pension, with amounts subject to periodic government adjustments.
  • Non-resident workers: Only employers contribute (MOP 200/month), but non-residents are not entitled to old-age pensions.

Employer and Employee Contributions

  • Local employees – Employer: MOP 90 per month; Employee: MOP 30 per month.
  • Non-resident employees – Employer: MOP 200 per month; Employee: no contribution.

These contributions fund old-age pensions as well as other benefits such as maternity, disability, and unemployment support.

Private Retirement Schemes

Although not required by law, some employers in Macau offer supplementary retirement or savings plans, especially in professional services, finance, and multinational corporations. These plans help attract and retain senior talent.

Compliance Considerations

Employers should:

  • Ensure timely registration and payment of contributions to the Social Security Fund.
  • Communicate retirement benefit entitlements clearly to employees.
  • Avoid age-based termination practices that could result in disputes or claims of unfair dismissal.
