Annual Leave & Other Leave Policies in Thailand

Thailand's labour laws provide various leave entitlements to employees, ensuring their well-being and work-life balance. Below is an overview of key leave types, accrual and usage policies, notice and approval requirements, public holidays for 2025, and employee rights.

Annual Leave Entitlement

Employees who have completed one full year of continuous service are entitled to a minimum of six working days of paid annual leave each year. Employers may grant additional leave based on company policies or employment contracts. ​

 

Sick Leave / Medical Leave

Employees are entitled to paid sick leave for up to 30 working days per year. If an employee is absent due to illness for three or more consecutive working days, the employer may require a medical certificate from a licensed physician or medical establishment. ​

 

Maternity Leave

As of 7 December 2025:

  • Maternity Leave will be extended from 98 calendar days to 120 calendar days per pregnancy.
  • Employers will be responsible for paying full wages for the first 60 days of leave (per pregnancy).
  • The remaining period (out of the 120 days) will have partial coverage under the Social Security Office for 45 days.

(Effective as of 7 December 2025) Additional leave for Infant Care Leave:

    • Following the utilization of maternity leave, a female employee is entitled to take up to an extra 15 consecutive days’ leave to care for a newborn child if the infant suffers from a medical condition, complications, abnormalities or disabilities. However, employee is required to present the medical certificate during the additional leave.
    • Employers will be responsible for paying with wages paid at 50% of regular rate.

 

Paternity Leave / Spousal Leave for Childcare

As of 7 December 2025:

  • The spouse of the female employee is entitled to 15 days (per pregnancy) to assist with childcare, to be taken within 90 days before or after childbirth.
  • Employers will be responsible for paying full wages for 15 days.

Other Leaves:

  • Weekly holiday (Rest day/Offday): not less than 1 day per week
  • Personal leave: 3 days
  • Leave for Military service: 60 days per year

 

Accrual and Usage of Leave

The accrual and usage of leave entitlements, such as annual leave, are generally determined by the employer’s company policy. There are no specific laws regulating the accrual or pro-ration of leave entitlements and paying cash in lieu of leave. ​

In general, unused annual leave may be carried forward, or the employer may choose to pay cash in lieu of unused leave, particularly upon termination of employment required by law.

The proration based on fixed 30 days.

 

Notice and Approval

Employees are typically required to provide advance notice to their employers when intending to take annual leave, as stipulated by company policy. For sick leave extending beyond three consecutive working days, a medical certificate may be required.

Employee Rights

Employees in Thailand are entitled to certain rights and protections under labor laws, including:​

  • Severance Pay: Employees with 20 years or more of service are entitled to 400 days of statutory severance pay, an increase from the previous 300 days for employees with at least 10 years of service.
