What is the Employee Insurance Policy in Thailand?

The primary employee insurance policy in Thailand is the Social Security Fund (SSF), established under the Social Security Act B.E. 2533 (1990). The SSF offers a range of benefits, including:​

  • Maternity Benefits: Financial support during maternity leave.​
  • Disability Benefits: Assistance in case of disability.​
  • Death Benefits: Funeral expenses and survivor allowances.​

  • Old-Age Pension: Retirement benefits for eligible employees.​
  • Unemployment Benefits: Support during periods of unemployment.​

In Thailand, the Social Security Fund (SSF) and the Workmen’s Compensation Fund (WCF) are separate funds, though both are administered by the Social Security Office (SSO) under the Ministry of Labour.

The Workmen’s Compensation Act B.E. 2537 (1994) and its Amendment (No. 2) B.E. 2561 (2018) established the Workmen’s Compensation Fund to provide protection and assistance to employees and covers compensation for work-related injury, illness, disability, or death while performing duties for their employer.

Workmen’s Compensation Fund (WCF) is also mandatory but only contributed by the employer. Employers must submit the annual WCF contributions based on the nature of the business and risk classification.

 

Is Employment Insurance Required?

Yes, participation in the Social Security system is mandatory for both employers and employees in Thailand. Employers are required to register their employees with the Social Security Office and make regular contributions to the SSF. This mandatory participation ensures that all employees receive the stipulated benefits under Thai law.

 

Premiums and Coverage

Both employers and employees are obligated to contribute to the SSF. Each party contributes 5% of the employee’s monthly salary, with a cap at THB 750 per month. This means that contributions are calculated based on the employee’s salary, up to a maximum salary of THB 15,000. The contributions fund various benefits, including medical treatment, maternity leave, disability support, and more.

 

Compliance and Legal Requirements

Employers must comply with the following legal requirements:​

  • Registration: Employers must register their business and employees with the Social Security Office.​
  • Timely Contributions: Both employer and employee contributions must be submitted monthly.​
  • Record Keeping: Maintain accurate records of wages and contributions.​
  • Reporting: Notify the Social Security Office of any changes in employment status, such as hiring or termination.​

Failure to comply with these requirements can result in penalties, including fines and legal action.
